AL GOBIERNO ECUATORIANO: ANTE LA SOLICITUD DE DISOLUCIÓN Y EXTINCIÓN DE ACCIÓN ECOLÓGICA Y EN SOLIDARIDAD CON EL PUEBLO SHUAR // TO THE GOVERNMENT OF ECUADOR: REGARDING THE ORDER TO CLOSE DOWN AND DISSOLVE ACCIÓN ECOLÓGICA AND IN SOLIDARITY WITH THE SHUAR COMMUNITY

AL GOBIERNO ECUATORIANO: ANTE LA SOLICITUD DE DISOLUCIÓN Y EXTINCIÓN DE ACCIÓN ECOLÓGICA Y EN SOLIDARIDAD CON EL PUEBLO SHUAR

Ante la solicitud de procedimiento administrativo de cierre (extinción y disolución) de la organización ecologista ecuatoriana Acción Ecológica por parte del gobierno (notificada por el Vice-Ministro de Seguridad Interna al Ministro del Ambiente, Diego Torres Saldaña (MDI-VSI-2016-00033), queremos solidarizarnos y expresar nuestro apoyo a la labor de defensa del medio ambiente desde un compromiso pacifista y no violento por más de 30 años de Acción Ecológica.

La notificación del Ministerio del Interior al Ministerio del Ambiente, aduce como razón para el cierre la supuesta vinculación entre “las acciones y hechos violentos acaecidos” en el contexto del conflicto entre la comunidad shuar y el proyecto minero de la empresa ECSA, con la difusión por parte de Acción Ecológica de «los graves impactos ambientales y al ecosistema que resultarían de la actividad extractivista» en la Cordillera del Cóndor y por alertar sobre la “supuesta violación de derechos humanos de las comunidades que viven en esta zona”.

Entendemos que no existe tal relación entre una cosa y la otra. Entendemos que el ejercicio de la libertad de expresión de los puntos de vista sobre los impactos ambientales y sociales de un determinado proyecto, en ningún caso debe ser criminalizado ni vinculado a los hechos a los que se alude.

Acción Ecológica hace un uso totalmente correcto de este derecho a la libertad de expresión, además, amparándose en que ésta es la finalidad por la cual fue creada y legalizada la organización, tal como se expresa en sus estatutos (artículo 2): «Promover la defensa de los derechos de la naturaleza con el fin de asegurar la preservación de un medio ambiente sano y alcanzar los derechos del buen vivir, promoviendo el respeto integral».

Acción Ecológica también ratifica que “se ciñe estrictamente al ordenamiento jurídico y que sus acciones están en plena armonía con el Plan Nacional del Buen Vivir 2013-2017, cuyo Objetivo 7.12.b señala que es una prioridad: «Optimizar la gestión ambiental participativa y el control social para la conservación de la biodiversidad terrestre y marina, mediante procesos de integración comunitaria que consoliden una cultura de paz y sostenibilidad en los territorios bajo régimen especial, así como en la circunscripción territorial especial de la Amazonia».

La posición de Acción Ecológica en torno al conflicto en la Cordillera del Cóndor es y ha sido la de “solicitar una comisión de paz y armonía con la naturaleza, en la creencia de que para alcanzar esta paz, se necesita un baño de verdad sobre lo que está ocurriendo en esos territorios del país”.

Por otra parte Acción Ecológica es integrante de la Federación Internacional de Derechos Humanos-FIDH y, como tal, entendemos que es lógico y entra dentro de su mandato como organización interesarse y alertar sobre posibles violaciones de los derechos del pueblos shuar, en este caso, o a los derechos humanos de determinadas personas en el transcurso de un conflicto socio-ambiental, más allá de que su opinión sobre estos hechos coincida o no con la del gobierno o las autoridades locales.
En una época de tan graves retos ambientales a los que debemos enfrentarnos, a escala local y como comunidad global, pensamos que es totalmente necesaria la labor de organizaciones como Acción Ecológica y desde aquí queremos expresar nuestra solidaridad en este momento, así como nuestra solidaridad y preocupación por la situación del pueblo Shuar, la necesidad del levantamiento del estado de excepción y las medidas de fuerza como forma de desescalar el conflicto.
Finalmente queremos hacer un llamamiento para encontrar una solución pacífica y negociada al conflicto en la cordillera del Cóndor con garantías para atender a los legítimos derechos ancestrales de la nacionalidad shuar y los derechos de la naturaleza.

TO THE GOVERNMENT OF ECUADOR: REGARDING THE ORDER TO CLOSE DOWN AND DISSOLVE ACCIÓN ECOLÓGICA AND IN SOLIDARITY WITH THE SHUAR COMMUNITY

In response to the request for an administrative proceeding of closure (abolishment and dissolution) of the Ecuadorian environmental organization Acción Ecológica by the government (notified by the Deputy Minister of Internal Security to the Minister of the Environment, Diego Torres Saldaña (MDI-VSI-2016-00033)), the signatories below express our support to Acción Ecológica for their work defending the environment from a pacifist and non-violent standpoint for more than 30 years.

The notification from the Ministry of the Interior to the Ministry of the Environment states, as a reason for closing the organization, the supposed link between «actions and violent events» in the context of the conflict between the Shuar community and the mining project of ECSA, as Acción Ecológica denounced «the serious environmental and ecosystem impacts that would result from the extractive activity» in the Cordillera del Cóndor, and for warning about the «alleged violation of human rights of communities living in this area.»

There is no such relationship between one thing and the other. Exercising the freedom of expression about views on the environmental and social impacts of a given project should not be criminalized or linked to the events mentioned in the notice.

Acción Ecológica makes completely correct use of this right to freedom of expression. Even more so when taking into account that this is the purpose for which the organization was created and legalized, as expressed in its statutes (article 2): «To promote the defense of the rights of nature in order to ensure the preservation of a healthy environment and achieve the rights of good living, promoting full respect.”

Acción Ecológica also ratifies that it “strictly adheres to the legal system” and that its actions are in full harmony with the National Plan for Good Living 2013-2017, whose Goal 7.12.b states that it is a priority: “To optimize participatory environmental management and social control for the conservation of terrestrial and marine biodiversity, through processes of community integration that consolidate a culture of peace and sustainability in the territories, under special regime, as well as in the special territorial circumscription of the Amazon.

The position of Acción Ecológica about the conflict in the Cordillera del Cóndor is and has been to “request a commission of peace and harmony with nature, in the belief that to achieve this peace, a truth bath is needed about what is occurring in those territories of the country. »

On the other hand, Acción Ecológica is a member of the International Federation of Human Rights (FIDH) and, as such, we understand that it is logical and within its mandate as an organization to take interest in and alert about possible violations of the rights of the Shuar peoples, or the human rights of certain persons in the course of a socio-environmental conflict, regardless of whether their opinion on these facts coincides with that of the government or local authorities.

In a time in which we face such serious environmental challenges at a local level and as a global community, we believe that the work of organizations like Acción Ecológica is imperative, and we express our solidarity in this moment, as well as our solidarity and concern about the situation of the Shuar people, as well as the need to lift the state of emergency and measures of force as a way to de-escalate the conflict.
Finally, we call for a peaceful and negotiated solution to the conflict in the Cordillera del Cóndor, with guarantees to attend to the legitimate ancestral rights of the Shuar nation and the rights of nature.
